The EEOC Defines an Internet Job Applicant

The Equal Employment Opportunity Commission has published its draft guidelines for what constitutes a job applicant on the Internet. This is important because it dictates record-keeping tactics to prove compliance with anti-discrimination laws.

In essence, the guidelines state that a person is an applicant if three conditions are met:

  1. The employer has taken steps to fill a particular position; as in posting the job online.
  2. The individual has expressed an interest in that particular position; that interest may be signaled by submitting a resume or otherwise communicating their desire to be considered for the job.
  3. And, the individual has followed the employer’s standard application procedure.
